Growing Spaces Order Terms and Conditions

These terms explain how an order becomes final, which documents apply, and what you and Growing Spaces can expect from each other.

1. Who these terms cover

These Order Terms and Conditions apply when you buy from the Growing Spaces online store or when another order document says they apply. The seller is Perennial Harvest LLC, a Colorado limited liability company doing business as Growing Spaces. In these terms, “Growing Spaces,” “we,” “us,” and “our” mean Perennial Harvest LLC. “You” means the person or organization placing the order.

These terms cover greenhouse structures, kits, parts, accessories, supplies, and other products we sell. They cover a service only when your quote, order confirmation, or separate service agreement says so. Installation and other services are governed by the applicable separate agreement.

2. When you agree to these terms

When you place an order after accepting these terms, you agree to them and acknowledge the Return and Refund Policy, Shipping Policy, and Limited Warranty that applies to your product. Our Privacy Policy is a notice about how we handle personal information. It is not a condition of purchase. If you order for an organization, you confirm that you have authority to bind that organization.

3. Which document controls

Your order may include these Order Terms, an order confirmation, an accepted quote, product specifications, a written warranty, and a separate agreement. If two documents conflict, the first applicable item in this list controls unless a document clearly says otherwise:

1.   A signed or electronically accepted project, purchase, installation, maintenance, or custom-work agreement, but only for its stated scope.

2.   The accepted quote and order confirmation, including product, price, quantity, and delivery details.

3.   The applicable written warranty, for warranty coverage and remedies.

4.   The Return, Cancellation, and Refund Policy and the Shipping, Freight, Delivery, and Pickup Policy, for the subjects they cover.

5.   These Order Terms.

A lender’s documents control the credit relationship between you and the lender. They do not change our product, installation, shipping, or warranty obligations.

4. When we accept an order

Your order is an offer to buy. An automated receipt or payment authorization confirms that we received the order, but it does not mean that we accepted it. We accept an order when we send an acceptance or production confirmation, ship the goods, or begin the agreed services.

Before acceptance, we may decline or cancel an order because of a pricing or description error, suspected fraud, a legal restriction, product unavailability, a shipping limit, or another condition that prevents us from completing the order as presented. If we cancel after collecting payment, we refund the amount collected for the cancelled item or order.

5. Product details and availability

We work to describe products, options, dimensions, colors, and availability accurately. Colors, screens, natural materials, and parts from different manufacturing runs may vary within reasonable tolerances. Photos may show optional items that are not included. The product page, accepted quote, and order confirmation state what your order includes.

We may correct a material pricing or description error before we accept the order. If we need to change a material term after acceptance, we contact you and obtain any consent the law requires.

6. Prices, taxes, and payment

We show prices in U.S. dollars unless we identify another currency. Taxes, shipping, delivery, permits, site work, owner-supplied materials, installation, and other charges are included only when we itemize them. You authorize us to charge the payment method you select for the amount shown at checkout.

Checkout orders require full payment unless your order confirmation, approved financing, or signed agreement states a different schedule. Permit-dependent, institutional, custom, and installed projects may require a quote, deposit schedule, or separate agreement outside ordinary checkout.

7. Financing

Affirm checkout financing

Affirm checkout financing may be available for eligible purchases. Affirm or its lending partners provide the credit and set its terms, subject to their approval. Growing Spaces is not the lender and does not decide your credit approval, annual percentage rate, fees, repayment schedule, or credit reporting. Unless checkout says otherwise, Affirm must authorize the full order amount before we release the order. We send an eligible refund to Affirm, which adjusts the loan under its terms.

Salal project financing

Salal financing is available only for qualifying residential Growing Dome projects in eligible locations. It is not available through Shopify checkout. Contact a Growing Spaces advisor before you place or pay for an online order.

A project must meet all of these conditions:

1.   The same Growing Spaces quote includes the Growing Dome kit and Full Crew Installation.

2.   Any financed interior additions are eligible under the program, appear on the same quote, and fit within the approved amount.

3.   Salal approves the applicant’s credit, membership eligibility, underwriting, and program requirements.

Although the Growing Dome kit and Full Crew Installation must appear on the same Salal project quote, installation remains a separate service governed by the Growing Spaces Installation Agreement. Salal-financed projects are not available through Shopify checkout.  Salal Credit Union provides the financing. Growing Spaces is not the lender. Rates, terms, loan amounts, and program availability may change. We do not release the order to production until the loan closes or you arrange another payment method that we accept. A Salal loan may be secured by a UCC filing against the financed products. Salal’s loan documents explain any security interest and control the credit relationship. Our quote and project agreements control the product and installation.

8. Changes and cancellations

The Return, Cancellation, and Refund Policy and any controlling signed agreement explain how you may change or cancel an order. A change takes effect only after we confirm it in writing. A change may affect price, tax, financing approval, production, shipping, and installation timing.

9. Your site, permits, and owner-supplied work

For a greenhouse, shelter, or other product assembled or anchored at a site, you are responsible for the following items unless your order documents say otherwise:

1.   Choose and prepare the site.

2.   Provide foundations and anchorage that we do not expressly include.

3.   Provide utilities, drainage, delivery access, and safe working access.

4.   Obtain permits and inspections and meet zoning, covenant, legal, and property requirements.

We identify project-specific or jurisdiction-specific engineering documents in writing. General drawings and manuals do not show that a product is approved for every site or code requirement. Review the current owner documents before delivery and assembly. Owner-supplied items, foundation requirements, tolerances, equipment, and crew needs vary by product and configuration.

10. Installation services

Installation is not included with an online product purchase and is not sold through Shopify checkout. To purchase installation services, you must receive and accept a separate written installation quote and Growing Spaces Installation Agreement.

The quote and Installation Agreement govern the installation scope, price, payment schedule, timing, site requirements, changes, cancellations, and workmanship coverage. Buying a kit does not reserve installation services or an installation date.

11. Shipping, delivery, and inspection

The Shipping, Freight, Delivery, and Pickup Policy is part of these Order Terms. It explains parcel and freight shipping, pickup, delivery access, unloading, delays, inspection, damage reporting, and when risk transfers. Read it before you order a product that ships by freight.

12. Written warranties and your legal rights

Review the complete Limited Product Warranty linked from the product page before you buy. A manufacturer warranty may also apply to a third-party component. A salesperson, installer, dealer, or other person cannot change a written warranty. Only Growing Spaces may change its written warranty in a signed writing.

The written warranty does not replace an implied warranty or remedy that applicable law gives you. Nothing in these Order Terms excludes or limits responsibility or a right that applicable law does not allow us to exclude or limit.

13. Use, safety, and maintenance

Use each product only for its stated purpose. Follow current instructions, warnings, maintenance requirements, and applicable laws. Do not change structural components, design loads, anchorage, glazing, electrical components, or safety systems without qualified review and any required written approval. You are responsible for supervising children, visitors, workers, and animals at the site.

14. Plans, manuals, and protected materials

Growing Spaces and its licensors own or license the designs, plans, manuals, videos, trademarks, and other protected materials we provide. We give the original purchaser a limited, nonexclusive, nontransferable right to use product documents to assemble, operate, maintain, and repair the purchased product.

You may give necessary excerpts to your permitting authority and to contractors working on your project if they use the materials only for that project. Without our written permission, you may not use the materials to manufacture a copy of the product, publish or sell the documents, or support another project.

15. Delays outside either party’s control

Neither you nor Growing Spaces is responsible for a delay caused by an event outside that party’s reasonable control, such as severe weather, natural disaster, fire, government action, transportation interruption, labor disruption, or supply interruption. The affected party must provide reasonable updates and resume work when practical. This section does not remove a cancellation, delay-notice, or refund right that applicable law gives you.

16. Resolving a problem

Contact support@growingspaces.com first so we can try to resolve the problem directly. If we cannot resolve it, either party may pursue available remedies in any court with jurisdiction, including small claims court when eligible. Colorado law governs these Order Terms to the extent permitted. This section does not remove a mandatory right or protection under the law that applies where you live.

17. Other terms

If a provision cannot be enforced, the remaining provisions continue to apply as far as the law allows. If we do not enforce a provision once, we do not waive the right to enforce it later. You may not transfer an accepted project or service order without our written consent unless the law allows the transfer. We may use qualified carriers, vendors, and subcontractors to perform our work. We remain responsible for the obligations assigned to us in the controlling order documents.

18. Updates to these terms

We may update these terms for future orders. The version you accepted governs your order unless you and Growing Spaces agree to a change or the law requires one. The date at the top identifies the version.

Shipping, Freight, Delivery, and Pickup Policy

This policy explains when an order is ready for production, how large freight deliveries work, and who carries the financial risk during transit.

1. How we ship

We may ship a product by a small-parcel carrier, freight carrier, dedicated truck, local delivery, or customer pickup. The product page, checkout, quote, or order confirmation identifies the expected method. We may split an order into more than one delivery.

2. Lead time and release to production

A made-to-order greenhouse structure kit typically ships four to eight weeks after release to production. An order is released to production after we accept it, receive the required payment or lender authorization, receive your final configuration approval, and resolve any information we still need from you. The product page or order confirmation gives the timing for a stock item.

Season, configuration, material availability, and freight capacity may affect timing. Installation scheduling is separate and may occur after delivery. A shipping date is an estimate unless we agree in writing to a guaranteed date.

If we cannot ship within the promised time or the time applicable law allows, we provide any required delay notice. When required, you may accept the delay or cancel for a prompt refund.

3. Shipping charges and delivery address

Checkout or your order documents show known shipping, freight, delivery, liftgate, limited-access, redelivery, storage, and special-handling charges. After a shipping or delivery service is performed, we do not refund that charge unless our error caused the charge or applicable law requires a refund. Give us a complete, accurate address that a carrier can safely serve, and tell us promptly if it changes.

4. Small-parcel delivery

We provide tracking when it is available. Monitor the tracking and provide a secure delivery location. Report a missing, incorrect, or visibly damaged parcel promptly, preferably within five business days after delivery, so we can investigate. This requested reporting period does not remove a right that applicable law gives you.

5. Prepare for freight delivery

A structure kit or another large product may arrive in heavy crates on a full-size tractor-trailer or large box truck. Before shipment, confirm a safe route and unloading area. Check road and bridge capacity, grade, width, height, turning space, and unloading space. Tell us about gates, overhead wires, trees, snow, mud, steep grades, residential-street limits, or another condition that may block service.

Standard freight includes only the services identified in writing. Unless we list them, it excludes a liftgate, forklift, crane, inside delivery, placement at the build site, unpacking, debris removal, and installation. Before shipment, tell us if you need a smaller truck, liftgate, appointment, limited-access service, or another accommodation.

You are responsible for approved added charges and redelivery or storage costs only to the extent that your action, refusal, absence, or an undisclosed access condition causes them. We request a carrier call before delivery, but the carrier controls the arrival window. No one should direct an unsafe unloading.

6. Inspect freight before you sign

1.   Inspect the exterior of the shipment and compare the piece count before you sign the freight paperwork.

2.   Write specific visible damage or shortages on the delivery receipt or bill of lading. Do not write only “subject to inspection.”

3.   Take clear photos of the shipment, labels, packaging, and damaged areas.

4.   Contact support@growingspaces.com promptly and keep the goods and packaging while we review the claim.

5.   Report concealed damage as soon as you find it. Do not discard, repair, or return damaged freight without instructions unless you need to prevent injury or further damage.

Prompt documentation helps us recover from the carrier. Missing carrier paperwork does not by itself transfer our financial risk to you or remove a right that applicable law gives you.

7. Risk of loss or damage

For a consumer shipment that Growing Spaces arranges, we carry the financial risk of loss or damage until delivery to the agreed address. We manage the carrier claim and may ask you for photos, preserved packaging, or access to inspect the shipment.

If you pick up the order or select and hire the carrier, risk transfers when we release the goods to you or that carrier. After a delivery attempt, you are responsible only to the extent that your action, refusal, absence, or undisclosed access condition causes a loss. An institutional, commercial, or custom order may use a different written rule in its signed agreement.

8. Customer pickup and Growing Spaces delivery

For customer pickup, bring suitable transportation, securement, and handling equipment. Risk transfers when we release the order to you or your authorized carrier. For a direct Growing Spaces delivery, risk transfers after delivery at the agreed location unless the delivery documents say otherwise.

9. Postpone a delivery

If you postpone delivery, carrier, handling, redelivery, and storage charges may apply. A made-to-order structure may also have a postponement charge stated in the accepted quote or signed agreement. The exact charge, if any, comes from that order document.

10. Backorders and split shipments

If an item is unavailable, you may wait, accept an available substitute, receive a split shipment, or cancel that item. We do not make a material substitution without your consent or charge added shipping caused only by our backorder unless you request a different method.

11. Financing does not change delivery rules

Financing does not change lead times, delivery access, inspection, damage reporting, or the risk rule in this policy. We coordinate a Salal-financed project outside Shopify checkout under the accepted quote, installation agreement, and lender process.

Growing Spaces Limited Product Warranty

This Limited Product Warranty describes the written warranty Growing Spaces provides for the structural components listed below. A manufacturer warranty may separately cover glazing or another third-party component.

1. Who this warranty covers

Perennial Harvest LLC, doing business as Growing Spaces, provides this warranty to the original purchaser of an eligible product. Coverage does not transfer unless Growing Spaces approves the transfer in writing or applicable law requires it. A later owner may contact us for available support and paid services.

2. Five-year structural coverage

Both the Growing Dome® and Growzebo are covered for 5 year from deliver or customer pickup against structural failure caused by a defect in structural struts or hubs supplied by Growing Spaces.

A covered failure must occur during the warranty term. Correct assembly, anchorage, operation, and maintenance affect product performance, but a change or maintenance issue does not end unrelated coverage. We exclude a claim only to the extent that an excluded cause produced the failure.

3. Glazing and third-party components

The manufacturer’s current written warranty for the exact product and component, if any, controls polycarbonate glazing and another third-party component unless Growing Spaces clearly provides added coverage in writing. We make an applicable manufacturer warranty available on the product page or on request before you order. We pass through an assignable manufacturer warranty and provide reasonable documents and claim support. A manufacturer may require product registration or other claim steps.

4. Other products

For a part, accessory, fan, vent opener, pump, control, garden product, or other good, check the product page and documents included with the product. Only the Growing Spaces or manufacturer warranty identified there applies. If neither source identifies a written warranty, this page does not create an added Growing Spaces warranty. This does not remove an implied warranty or other right that applicable law gives you.

5. What this warranty does not cover

This warranty does not cover a failure or cost caused by the following items, except where another applicable written warranty or applicable law says otherwise:

1.   Foundation, anchorage, site work, drainage, utilities, owner-supplied materials, landscaping, or work outside the written scope.

2.   Improper assembly, installation, repair, operation, maintenance, storage, relocation, or modification.

3.   Accident, abuse, misuse, vandalism, animals, chemicals, fire, flooding, impact, falling objects, or other external causes.

4.   Loads or conditions beyond the product’s stated design and site requirements, including unapproved snow, wind, occupancy, suspended, or equipment loads.

5.   Normal wear, cosmetic change, condensation, ordinary water entry not caused by a covered defect, corrosion or degradation caused by the local environment, and consumable maintenance items.

6.   Labor, travel, access equipment, removal, reinstallation, expedited freight, site restoration, crop loss, loss of use, or third-party work, unless we separately promise that coverage in writing or applicable law requires it.

6. What we will do for a covered defect

If we confirm a covered defect, Growing Spaces will choose to repair the covered component, provide a replacement component, or refund the part of the purchase price assigned to that component. We may use a new or functionally equivalent part.

For an approved replacement part shipped within the contiguous United States, we cover ordinary outbound shipping. For another destination, we credit the amount of ordinary shipping to a contiguous U.S. destination, and you pay the remaining cost. Unless we separately promise it in writing or applicable law requires it, the remedy does not include labor, travel, access equipment, removal, reinstallation, expedited freight, or site work.

These written-warranty remedies do not replace another remedy that applicable law gives you.

7. Make a claim

1.   Contact support@growingspaces.com or 800-753-9333 promptly after you discover the issue. Report it within 30 calendar days when practical. A later report does not end coverage unless the delay materially harms our ability to review the claim or applicable law allows that result.

2.   Provide the purchaser name, order number, product and component, site location, assembly or installation information, maintenance history, and dated photographs or video.

3.   Take reasonable steps to prevent further damage. Do not discard or alter the claimed component before inspection or written authorization unless safety requires it.

4.   We may request remote troubleshooting, more documents, return of the component, or a reasonable inspection. Get our authorization before you pay a third party for a repair and ask us to reimburse that cost.

8. Your legal rights

This Limited Product Warranty gives you specific legal rights. You may have other rights that vary by state, province, territory, or country. We do not disclaim implied warranties. A limit in this warranty does not apply where applicable law does not allow it.

Return, Cancellation, and Refund Policy

This policy applies to purchases from Growing Spaces unless an accepted quote or signed agreement gives different terms for your order. Stock items, made-to-order structures, structurally custom goods, special-order goods, and services follow different rules.

1. Start a return or cancellation

Contact support@growingspaces.com or 800-753-9333 and include your order number. Wait for our instructions and any required return authorization before you ship an item. Do not send a return to our physical or mailing address without authorization.

2. Return a standard stock item

You may return an unused standard stock item that is complete and resalable. Request authorization within 30 calendar days after delivery, then ship the item by the deadline in the authorization.

We do not charge a restocking fee for an unopened item. If an opened item remains resalable, we may deduct only the documented loss in value caused by use, damage, missing parts, or packaging damage beyond what was reasonably necessary to inspect the item.

You pay return shipping unless we sent the wrong item, the item was damaged before risk transferred to you, the item is defective, or applicable law requires us to pay. We do not refund an original shipping or delivery charge after that service is performed unless our error caused the return or the law requires a refund.

3. Items outside the standard return rule

1.   Made-to-order greenhouse or shelter structures and their configured options. The cancellation rules in the next section apply instead.

2.   Structurally custom goods, custom-cut materials, special-order goods, and goods marked final sale.

3.   Installed, assembled, changed, used, or damaged goods, unless you have a valid defect, warranty, or legal claim.

4.   Opened consumables or sanitary goods that cannot be safely resold.

5.   Digital materials, permit or engineering documents, and completed services, unless applicable law gives you a refund right.

6.   Gift cards, if offered, unless applicable law requires redemption or a refund.

4. Cancel a made-to-order structure

Unless a controlling signed agreement gives different terms, the following schedule applies after we accept a made-to-order structure order:

1.   If you cancel more than 20 business days before the scheduled ship date, the cancellation charge is 5% of the cancelled structure subtotal.

2.   If you cancel within 20 business days before the scheduled ship date, the cancellation charge is 10% of the cancelled structure subtotal.

The cancelled structure subtotal includes the made-to-order structure and its configured options. It does not include taxes, shipping that we have not performed, installation or other services that we have not performed, or separately returnable stock items.

For a structurally custom order, the percentage schedule does not automatically determine the charge. We calculate a reasonable amount from documented, unrecoverable engineering, material, labor, and handling costs already committed to the cancelled work. We do not automatically keep the entire deposit, and we do not charge twice for the same cost. A standard catalog option does not by itself make an order structurally custom.

5. Cancel or reschedule a service

The applicable quote or service agreement controls cancellation and rescheduling for installation, supervision, maintenance, design, engineering, travel, custom interior work, and other services. Product and service cancellations are separate. We cancel both only when we confirm both in writing.

6. Shipping damage, shortages, and warranty claims

Use the Shipping Policy to report shipping damage or a shortage. Use the applicable Limited Product Warranty to report a product defect or covered failure. We do not treat these claims as ordinary change-of-mind returns. This policy does not remove a right that applicable law gives you.

7. How and when we issue a refund

We return an approved refund to the original payment method unless applicable law or the payment provider requires another method. We initiate a normal approved refund within 10 business days after we receive and inspect the return or confirm the cancellation amount. Your bank, card issuer, or lender may need more time to post it.

If we cannot ship within the promised time or the time applicable law allows, we provide any required delay notice and cancellation choice. When you cancel because we did not ship on time and did not obtain valid consent to a delay, we generally issue the refund within seven working days. We do not apply a made-to-order cancellation charge when the law gives you that delay-based cancellation right.

8. Refunds for financed orders

For an Affirm-financed order, we send an eligible refund to Affirm, which adjusts the loan under its terms. For a Salal-financed project, the Growing Spaces project documents and Salal loan documents control cancellation and refund handling. We do not issue a second cash refund for an amount a lender funded.

Perennial Harvest LLC owns or licenses Growing Spaces®, Growing Dome®, related names and logos, product designs, documents, and site content. We use Growzebo™ as a trademark. Other names and marks belong to their respective owners. Using this site does not give you a license to use these materials except for a limited permission stated in the applicable Order Terms or a signed agreement.

Website content provides general information. It does not replace product instructions, project-specific engineering, permit review, professional advice, or a signed scope of work. We may change product availability, specifications, prices, and policies for future orders. The documents you accept with an order control that order.

The Website Terms and Conditions govern use of the website.
